PROJECT TERMS
By using any of our services, you agree to abide by the Terms and Conditions set out herein. It is essential that you read the terms and conditions carefully which would form part of the contract for the Project of services utilized by you.
Your Project or use of our services implies that you accept these Terms and Conditions and agree to be legally bound by these Terms and Conditions. You must not use inFutive Technology Pvt. Ltd. BRAND TECH - FZCO services if you do not accept these Terms and Services. This agreement is effective as soon as you use the services of inFutive Technology Pvt. Ltd. BRAND - FZCO. You should visit this page frequently to review the Terms and Conditions as inFutive Technology Pvt. Ltd. BRAND TECH - FZCO reserves its right to amend these terms and conditions at any time without prior notice. The changes will be effective immediately after the time of posting of the updated Terms and Conditions.
During the project briefing, it is the client’s responsibility to provide us with clear guidelines along with the flow or specific details you may require. When such details are not provided, we will proceed with our understanding of your requirements and quote accordingly. At a later stage, if a discrepancy arises, it may lead to additional costs to accommodate the changes. Thus, it is essential that you clarify every aspect of your Web, 3D, Animation, & Graphic project and ensure that you have been quoted on the right requirements.
Once proposal has been finalized, any additions, changes or modifications or enhancements in the project will affect the proposal and may incur additional cost and a revised completion date. All additional work is charged separately. Under no circumstances will inFutive Technology Pvt. Ltd. BRAND TECH - FZCO be liable for any delays caused by the changes in the project.
All Content related to your project needs to be provided to us within the first week of starting the project unless discussed otherwise. Any delays thereafter may delay the project and may incur additional charges if it goes beyond reasonable timeframe.
The client must recognize that at times there may be unforeseen circumstances that will delay the project completion, particularly with reference to the integration of third-party software. We will try our best to complete the project as agreed in the proposal. As long as it is within a reasonable period, the client agrees not to penalize us for any genuine delay, when every effort to keep the project on the proposed schedule is taken.
With respect to Web projects inFutive Technology Pvt. Ltd. BRAND TECH - FZCO takes no responsibility of any of the third-party products, software or components used on the website development such as payment gateway, SSL certificates etc. We suggest you take regular back-ups to avoid any disruptions. Domain registration charges are not included as a part of the proposal unless discussed or mentioned otherwise. Hosting charges are not included in the quotations unless discussed or mentioned otherwise. inFutive Technology Pvt. Ltd. BRAND TECH - FZCO can organize an appropriate hosting solution if required, a quote for which will be submitted separately and approved by the client. In case clients decide to organize their own hosting, we should be consulted before finalizing the type of hosting and database, as it should meet the requirements of the technology used for the development. Please note that we’ll require full access with hosting support for testing and deploying the application. inFutive Technology Pvt. Ltd. BRAND TECH - FZCO will not be liable for any delay or error caused by direct or indirect actions of the hosting company.
PAYMENT / REFUND TERMS:
All prices are quoted in AED or US Dollars, exclusive of taxes as may be applicable.
50% of the payment shall be payable as advance at the time of execution of a written contract for the Project. Since we do not work on the milestone concept, remaining / outstanding payment must be made within 15 days of the Project completion.
In the event the Project is cancelled by the client for any unforeseen situation or any reasons after the payment of advance amount is received from the Client, and prior to commencement of the work by inFutive Technology Pvt. Ltd. BRAND - FZCO, no refund shall be made whatsoever. No cancellation of work would be entertained in situations where inFutive Technology Pvt. Ltd. BRAND TECH - FZCO has completed 50% of the Project. Clients would be obligated to pay the entire contractual amount to inFutive Technology Pvt. Ltd. BRAND TECH - FZCO in the event the Project is cancelled after the completion of 50% of the Project. Failure to do so, would attract legal consequences and inFutive Technology Pvt. Ltd. BRAND TECH - FZCO reserves its right in taking appropriate legal action for recovery of the amount legally due and recoverable from the Client. Any charges associated with the recovery of the outstanding amount legal fees, court fee, interest, etc. shall be at Client’s risk and costs. All cancellations must be sent in writing via regular mail or email. Telephone requests on cancellations will not be accepted.
Late Fees and Charges: Delay in making payments/invoices will attract a late payment fee of 10% of the pending amount and an administration fee of USD 7 per month, from the due date.
Due Date: Due date is the date on which the payment/invoice is due as per the terms of the proposal.
Outstanding Payment/Invoice: Payment/Invoice is deemed to be outstanding if it is still due after 15 days of the expiry of the due date, unless otherwise agreed in the Contract.

All communications/correspondences are generally done via emails. It is client's responsibility to keep us updated with their relevant email addresses.
With respect to Web projects, any payment relating to the domain name registration renewal or hosting or any 3rd party products or service purchased on behalf of the client will have to be in full and is non-refundable. In case of web-hosting renewals all cancellations must be notified to us within a period of 30 days before the renewal date. If client chooses a 3rd party hosting provider, inFutive Technology Pvt. Ltd. BRAND TECH - FZCO will build and test the website on one of our own servers or hosted domains. The Website will be transferred-off to a 3rd party server upon the payment by the client.
INTELLECTUAL PROPERTY:
inFutive Technology Pvt. Ltd. BRAND TECH - FZCO has no ownership on the projects once completed, except the right to mention the projects in our portfolio or on the company website. Your projects will not be re-sold or presented to anybody for buying. The project once completed is exclusively yours.
inFutive Technology Pvt. Ltd. BRAND TECH - FZCO reserves the right to change the aforesaid contents or policies without any prior notice.
The violation of the terms & conditions will result in cancellation of services and no refund will be made.
DISPUTES, LIABLITY & INDEMNITY:
inFutive Technology Pvt. Ltd. BRAND TECH - FZCO reserves the right to refuse service to any client, if these are not aligned with our business operating principles and policies.
inFutive Technology Pvt. Ltd. BRAND – FZCO will not be liable for any breach of the agreement which is caused by a matter beyond its reasonable control including but not limited to Act of God, fire, lightning, explosion, war, disorder, flood, earth quake, industrial disputes (whether or not involving their employees), extremely severe weather, or acts of local or other government authorities.
The Agreement shall be governed by the Laws of UAE. The Courts of law at Dubai, UAE alone shall have the exclusive jurisdiction over any disputes arising under this agreement.
